The terms and conditions of working with A Shade Above ("The Company") include:
Cancellation Policy Disclaimer: Products are custom-designed and manufactured, changes cannot be made, or refunds given after the order has been placed.
Target Dates: The Company can not guarantee deadline target dates, as the production completion time is up to the discretion of the manufacturer and the shipping schedules of third-party freight forwarding companies. A Shade above is not liable for any expenses or costs arising as a result of such delivery delays.
Discontinuation of material: The Company is not responsible for the manufacturer's decision to discontinue an item or fabric; the company will make a re-selection with customer approval for the replacement of the product/fabric, and any cost difference will be the client's responsibility.
Installation Disclaimer: Prior to any installation services provided by A Shade Above, it is the responsibility of the purchaser to ensure that all valuables, furniture, and other items are removed from the work area. This ensures the safety of your belongings and facilitates a smoother installation process. Once installation is complete, the responsibility to replace these items rests with the purchaser. A Shade Above is not liable for damage to any items not removed from the installation area.
Electrical Wiring Disclaimer: A Shade Above furnishes pre-wiring guidelines for motorized units, intended for the use by professional third-party electrical contractors. These guidelines are sourced from the manufacturers of the motorized units and should be validated by a licensed electrical contractor. A Shade Above is not liable for any inaccuracies in these guidelines or any installation errors by the electrical contractor that result in property or motor damage. Additionally, owners of battery-operated window treatments are responsible for the regular charging and replacement of their battery units.
Quality Workmanship Guarantee: The Company will not offer compensation to any client whose product was damaged or delayed during the production process. The Company reserves the right to repair damaged merchandise or replace products that are under warranty with the manufacturer. As a custom product, installations may require follow-up appointments to make adjustments.
A Shade Above Labor Warranty: The Company offers a 1-year warranty on installation and for any services required to adjust the tailor-made products. Within 1 year from the final balance, we will send out a service tech free of charge to address these adjustments.
Manufacturer Limited Lifetime Product Warranty: Every manufacturer provides a limited product warranty covering original defects in materials or workmanship as long as the original purchasers own the product in the originally installed location by a certified installer. For more information on specific brand warranties, contact the office or your Designer.
Photography: The Company reserves the right to use the client’s “before and after” room/window pictures for advertising and marketing efforts. We retain the title to merchandise until it has been delivered or paid in full.
Wovens, Textiles And Draperies Disclaimer: A Shade Above acknowledges that fabric characteristics such as slubbing, stretch, stiffness, creasing, variation in dye lots, shadowing, and other imperfections are inherent and beyond our influence. Fluctuations in drapery and shade dimensions may be observed due to these intrinsic qualities and environmental factors. In compliance with the Window Covering Association of America (WCAA) standards, A Shade Above permits a tolerance of up to 1⁄2 inch in the final product measurements relative to specified dimensions.
Lien Rights: A Shade Above retains the right to file a lien against the property of a client for any outstanding payments. The property owner will be notified in advance of any lien action.
Legal Disclaimer: In the event that an unpaid invoice requires legal intervention, A Shade Above is entitled to recover reasonable attorneys' fees and court costs from the party at fault.
